Terms of Service

By using forestana.com or engaging Forestana for services, you agree to these terms. Forestana is operated by Ana Clara Santos Venâncio. Registered activity under ACS Consultorias (CNPJ on request). Enquiries: [email protected].

1. About these terms

These terms govern your use of the forestana.com website and any engagement of Forestana for professional services. By accessing the site or commissioning work, you confirm that you have read and agree to be bound by them. If you do not agree, please do not use this site or engage Forestana's services.

2. Services

Forestana offers geospatial analysis, cartographic design, interactive web maps, geotechnology training and web design services. The scope of any given engagement, including deliverables, timelines and fees, is agreed in writing in a separate project proposal or statement of work before work commences.

These terms apply in full unless explicitly varied in that project document. In the event of a conflict between a signed project document and these terms, the project document takes precedence.

3. Intellectual property

Work product created specifically for a client, including maps, reports, web files and spatial datasets derived from client-supplied data, passes to the client upon receipt of full payment, unless otherwise agreed in writing.

Underlying methodologies, reusable templates, GIS workflows, code libraries and design systems developed by Forestana remain Forestana's intellectual property unless their transfer is explicitly agreed in writing and reflected in the project fee.

Source data drawn from public sources, including MapBiomas, IBGE, FUNAI, ANA, INPE/PRODES and similar, remains subject to the respective licences of those providers. Forestana passes on any relevant attribution or licence obligations to the client.

4. Confidentiality

Forestana treats all client data, project information and communications as confidential. Client data will not be disclosed to third parties except as strictly necessary to deliver the project (for example, to a hosting provider or cloud processing service), or as required by Brazilian law. Subcontractors and service providers who handle client data are required to observe equivalent confidentiality standards.

5. Data handling, sensitive territorial information

Where projects involve spatial data relating to indigenous communities, traditional populations or sensitive territorial information, Forestana follows ethical principles aligned with FPIC (Free, Prior and Informed Consent) and the relevant community data governance frameworks.

Such data will not be published, shared publicly or transferred to third parties without the explicit consent of the communities or rights-holders concerned. The client takes responsibility for ensuring that any data they supply to Forestana has been collected lawfully and with appropriate consent.

6. Payment

Payment terms are specified per engagement. As a general practice, Forestana invoices 50% of the agreed fee on project commencement and 50% on delivery of final files. Alternative arrangements may be agreed in the project document.

Late payment beyond the agreed terms may result in suspension of work in progress. Forestana will give reasonable notice before suspending. Ownership of work product does not transfer until full payment is received.

7. Limitation of liability

Forestana's total liability in connection with any project engagement is limited to the value of fees paid for that specific engagement. This limit applies to all claims, whether in contract, negligence or otherwise.

Forestana is not liable for decisions made by clients, their partners or third parties on the basis of delivered maps, spatial analysis, reports or web tools. Geospatial data and analysis reflect the sources and methodologies described in the project deliverable; clients are responsible for validating fitness for purpose before relying on outputs for legal, regulatory or financial decisions.

8. Governing law

These terms are governed by and construed in accordance with Brazilian law. Any dispute arising from or in connection with these terms or a project engagement shall be subject to the exclusive jurisdiction of the courts of Acre, Brazil.

9. Changes to these terms

Forestana may update these terms from time to time. Updated terms will be posted on this page with a revised date. Continued use of the site or ongoing engagement with Forestana after an update constitutes acceptance of the revised terms. For active project engagements, the terms in force at the time of project commencement apply unless both parties agree otherwise in writing.
